1st Amendment issue. You may say the Bill of Rights only describes rights for American citizens. But it doesn't at all. It describes things the government can't do, in any context. A reprisal for any right means the right doesn't exist since the only things government can do is create reprisals. You can't say, you have a right to free speech, but you are going to jail despite that right. A right is a restriction on government to respond in any negative way in response to your actions within that domain. And those restrictions are not dependent on who the government would be acting on, because the Bill of Rights is a list of things the government wholesale can't do.

The government basically can't do anything selectively based on what any person says.
